Key Advantages

01

Self-Petitioned

Unlike most other employment-based categories, the EB-1A does not require a U.S. employer to act as a sponsor. You can file the petition on your own behalf.

02

No Labor Certification Required

There is no need to go through the lengthy Department of Labor (PERM) process.

03

Family Inclusion

Upon approval, you, your spouse, and your unmarried children under the age of 21 are all eligible for U.S. Permanent Residency (Green Cards).

The Lingtu Approach: Turning Achievement into Narrative

Lingtu Law organizes the evidence, drafts the petition, and presents your professional record in a clear narrative aligned with USCIS standards and the issues immigration officers assess.

Who is Eligible for EB-1A? (Eligibility Overview)

To qualify for an EB-1A visa, you must demonstrate "extraordinary ability" through sustained national or international acclaim. You can establish this eligibility in one of two ways:

Option 1: A One-Time Achievement

Evidence of a major, internationally recognized award, such as a Nobel Prize, Pulitzer, Oscar, or Olympic Medal.

Option 2: Meeting at least 3 of the 10 USCIS Criteria

If you have not received a one-time major award, you must provide evidence that satisfies at least three of the following ten categories:

  1. Evidence of receipt of lesser nationally or internationally recognized prizes or awards for excellence in your field.
  2. Evidence of membership in associations that require outstanding achievements of their members, as judged by recognized experts.
  3. Evidence of published material about you and your work in professional/major trade publications or other major media.
  4. Evidence that you have been invited to judge the work of others, either individually or on a panel.
  5. Evidence of original scientific, scholarly, artistic, athletic, or business-related contributions that have had a major significance in your field.
  6. Evidence of authorship of scholarly articles in professional or major trade publications or other major media.
  7. Evidence that your work has been displayed at artistic exhibitions or showcases.
  8. Evidence that you have performed a leading or critical role in organizations or establishments that have a distinguished reputation.
  9. Evidence that you command a high salary or other significantly high remuneration in relation to others in the field.
  10. Evidence of commercial successes in the performing arts.

Attorney's Insight: While the official USCIS guidelines mention traditional formats like box office receipts or DVD sales, the team at Lingtu Law APC interprets this criteria within a modern context. In today's digital economy, we successfully leverage data such as streaming counts, App download metrics, and commercial conversion rates from cross-platform social media to demonstrate the commercial impact of multidisciplinary talents and creators.

Am I “Extraordinary” Enough? (Real-World Examples)

Many clients mistakenly believe the EB-1A is only for world-famous celebrities or senior scientists. In reality, as long as you are in the top 10% of your specific niche, you may have a strong case. At Lingtu Law Office, we look at your achievements through a modern lens:

01

If you are in Business or Tech

  • A Lead Architect at a startup who spearheaded a high-growth App may qualify without holding a CEO title.
  • A critical role in a major funding round, or financial-media coverage of your business model, may support the case.

Example: An Operations Director for a cross-border e-commerce platform who created a proprietary algorithm that increased conversion rates by 30%.

Criteria met: Original Contribution + Media Coverage + Critical Role.

02

If you are in Arts or Creative Fields

  • A cross-platform creator on Instagram, YouTube, or TikTok may qualify through strong engagement and proven brand influence.
  • A global-brand collaboration or an invitation to judge an industry competition may support the case.

Example: An independent illustrator whose artwork was selected for a limited-edition global product launch by a well-known consumer brand.

Criteria met: Display of Work + Commercial Success + Originality.

03

If you are in Research or Education

  • A Senior Consultant in an emerging field, or an educator whose methodology has been adopted by multiple institutions, may qualify without publishing in top journals.
  • Research implemented by a major corporation may support the case even when the applicant has few papers or citations.

Example: A junior researcher in the autonomous driving field who holds two patents that are actively being used by industry giants.

Criteria met: Authorship + Judging/Reviewing + Original Contribution.

How We Work on EB-1A

The Lingtu Advantage: Defining Your Niche

In an EB-1A petition, how your evidence is interpreted is often more important than the evidence itself. You are likely more accomplished than you realize; you simply need a team that can "translate" your daily professional success into the legal language USCIS demands. The team at Lingtu Law APC specializes in:

01

Mining for “Gold”

We identify the hidden highlights in your resume that you might have overlooked.

02

Reframing the Narrative

We turn “App traffic” into Commercial Success, and “Internal peer reviews” into Judging Experiences.

03

Defining Your Kingdom

We help you narrow down your field to a specific niche where you truly reign supreme, avoiding overcrowded categories and increasing your chances of approval.

Timeline & Processing Overview

The EB-1A process is a journey of strategic preparation followed by federal adjudication and visa availability.

01

Phase 1: Legal Preparation (2–3 Months)

The goal of this stage is to build a case that can withstand close review.

  • Strategic Assessment: Defining your unique niche and success roadmap.
  • Evidence Architecture: Organizing hundreds of pages into a cohesive legal framework.
  • Master Drafting: Crafting the Petition Letter and expert Recommendation Letter frameworks.
  • Pre-Filing Audit: Final quality check to ensure every claim is backed by credible evidence.
  • Timeline Variable: While we aim for 2–3 months, we offer expedited workflows for urgent needs and deeper "rebuilding" for complex backgrounds.
02

Phase 2: USCIS Adjudication (15 Days to 18 Months)

Once your I-140 petition is filed, USCIS determines your eligibility.

  • Regular Processing: Currently averaging 12 – 18 months for a decision.
  • Premium Processing (Optional): USCIS guarantees a response within 15 business days for an additional government fee of $2,965.
03

Phase 3: Visa Backlog & Priority Dates (2–3 Years for China-Mainland)

For applicants born in mainland China, EB-1 is currently "oversubscribed," meaning there is a wait for visa availability even after your I-140 is approved.

  • Current Status: Applicants born in mainland China currently face an estimated 2 to 3-year wait before they can file for their final Green Card (Form I-485 or Consular Processing).
  • The "Priority Date": Your place in line is marked by your "Priority Date"—the date your I-140 was filed.
  • Strategic Benefit: Even with the backlog, the EB-1 remains the fastest path to residency compared to EB-2 or EB-3, which often have backlogs of 5-10+ years.
04

Phase 4: Final Residency (The Green Card)

Once your Priority Date becomes "Current" in the Visa Bulletin:

  • U.S. Residents: File Form I-485 to adjust status.
  • Overseas Residents: Undergo Consular Processing at a U.S. Embassy/Consulate.
  • Outcome: You, your spouse, and unmarried children under 21 receive your Permanent Resident Cards.
